ONS has no obligation to monitor the content of information you or anyone else places on our servers, but we may do so and disclose information regarding your use of the server for any reason if ONS, in its sole discretion, believes that it is reasonable to do so, including to: satisfy laws, regulations, or governmental or legal requests; operate the server properly; or protect itself and its customers. ONS may immediately remove your material or information from our servers, in whole or in part, which ONS, in its sole and absolute discretion, determines to infringe another's property rights or to violate our Acceptable Use Policy or other policies or laws. Any use of an ONS Managed Server for transmission or storage of any information, data or material in violation of any federal, state or local law or regulation including, but not limited to, the Telephone Consumer Protection Act (TCPA) [47 U.S.C. § 227], `CAN-SPAM Act of 2003', The Computer Fraud and Abuse Act, and USA PATRIOT Act, Children's Online Privacy Protection Act of 1998 (COPA) is strictly prohibited. The Telephone Consumer Protection Act of 1991 (TCPA) and Federal Communications Commission (FCC) rules prohibit sending unsolicited advertisements, also known as "junk faxes," to any fax machine. This prohibition applies to fax machines at both businesses and residences. You must comply with all export and re-export control laws, including but not limited to the Export Administration Act, the Arms Export Control Act and their implementing regulations, and you will not transfer, by electronic transmission or otherwise, any content derived from the our service to either a foreign national or a foreign destination without first obtaining any required government authorization. You further agree not to upload to the Service any data or software that cannot be exported without prior written government authorization. The terms "export" and "re-export" mean transferring or releasing technology to another country or to a national of another by any means - physical, electronic or otherwise. This includes the electronic transmission of information and software to foreign countries and to certain foreign nationals. Any prohibited usage or any usage in the sole opinion of ONS which violates the then current ONS Acceptable Use Policy, shall be deemed to be a violation of the Service Agreement by you. In the event of such a breach, ONS may, at its sole option, suspend Service, either in whole or in part, or may terminate your service in accordance with your Service Agreement.
